1. Acceptance of Terms
By accessing or using HCMPro (the "Service"), you ("you", "User", "Customer", or "Community") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
If you accept these Terms on behalf of a housing community, residential association, or other organization, you represent that you have the authority to bind that entity.
2. Definitions
- "Service" or "HCMPro" โ the housing community management software platform operated at https://hcmpro.in and related applications
- "SVTechPro", "we", "us", "our" โ the operator of the Service
- "Community" โ a residential housing community (apartment, villa, gated society) that subscribes to the Service
- "Community Admin" โ an authorized representative of a Community who manages the platform on its behalf
- "User" โ any individual with an account on the Service (admin, accountant, member, tenant, etc.)
- "Subscription" โ a paid annual plan for a Community to use the Service
3. Service Description
HCMPro is a multi-tenant SaaS platform that provides housing communities with tools for:
- Member, tenant, and unit management
- Maintenance billing and payment collection (UPI, Razorpay)
- Special levy creation and tracking
- Visitor pass generation and gate entry/exit logging
- Maintenance complaint ticketing
- Meeting scheduling, attendance, and minutes
- Governing body management
- Reports (dues ledger, defaulters, fund statement, P&L)
- WhatsApp, email, and push notifications
- Subscription management (for the Community to manage its own SVTechPro subscription)
We may add, modify, or remove features over time. We will provide reasonable advance notice of material changes that affect existing functionality.
4. Account Registration & Eligibility
- You must be at least 18 years old to create an account
- You must provide accurate and complete information when registering
- You are responsible for maintaining the confidentiality of your password
- You are responsible for all activity under your account
- You must notify us immediately at admin@hcmpro.in if you suspect unauthorized access
- One person should not share login credentials with others; each role-holder should have their own account
5. Subscription & Plans
5.1 Trial Period
New Communities receive a 30-day free trial with full feature access. No payment is required during the trial.
5.2 Plans
After the trial, the Community must subscribe to a paid plan to continue using the Service. Plan details (setup fee, annual price, unit limits, included features) are listed on our pricing section and are managed in the Service. SVTechPro reserves the right to change plan pricing with at least 30 days' notice for renewals.
5.3 Lifecycle
Your subscription progresses through these states:
- Draft โ Setup in progress
- Trial โ 30-day free access
- Active โ Paid subscription, full access
- Grace โ 7-day post-expiry buffer (read-only access)
- Suspended โ Service access blocked
- Expired โ Long-term inactive
5.4 Auto-Renewal
Subscriptions do not auto-renew. The Community Admin must manually pay for renewal each year. We will send renewal reminders via email and WhatsApp 30, 14, and 7 days before expiry.
6. Payment Terms
- All payments are processed through Razorpay (PCI-DSS Level 1 certified payment gateway)
- Subscription invoices are generated by SVTechPro and paid by the Community
- Member maintenance dues (collected via the Service) are routed to the Community's own bank account, not SVTechPro's
- All prices are in Indian Rupees (โน) and inclusive of applicable taxes unless stated otherwise

Important: SVTechPro acts only as a software platform provider. We do not act as a financial institution, payment aggregator, or escrow service. Member-to-Community payments are direct transactions between members and Communities, facilitated by Razorpay.
7. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of Indian law
- Upload viruses, malware, or attempt to compromise platform security
- Attempt to gain unauthorized access to other Communities' data
- Reverse-engineer, decompile, or scrape the Service
- Resell or sublicense the Service without written permission
- Use the Service to spam, harass, or send unsolicited messages
- Misrepresent your identity or impersonate others
- Interfere with the proper functioning of the Service
- Use the Service to store or transmit illegal, defamatory, or copyrighted content without right
Violation of acceptable use may result in immediate account suspension or termination without refund.
- Your data is yours. The Community owns all data it enters into the Service (member records, unit lists, payments, etc.).
- You grant SVTechPro a limited, non-exclusive license to use this data solely to provide the Service to you.
- You are responsible for the accuracy, legality, and content of all data you enter.
- You confirm that you have all necessary consents from your members and tenants to upload their personal data into the Service.
- Upon cancellation, you may request a data export within 30 days. After 90 days, data may be deleted (subject to legal retention requirements โ see Privacy Policy ยง7).
9. Intellectual Property
The HCMPro platform, including its source code, design, branding, logo, and documentation, is the exclusive property of SVTechPro. Nothing in these Terms grants you any ownership or licensing rights in the platform itself, except the limited right to use the Service per these Terms.
The "HCMPro" name and logo are trademarks of SVTechPro. Unauthorized use is prohibited.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:
- Implied warranties of merchantability or fitness for a particular purpose
- Warranties of uninterrupted or error-free operation
- Warranties regarding the accuracy or reliability of any information obtained through the Service
- Warranties of non-infringement
We do not guarantee that the Service will meet your specific requirements or be available at all times. We aim for high uptime but do not provide a formal SLA in the standard plan.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SVTechPro's total liability to you for any claim arising from the Service shall not exceed the amount you paid to SVTechPro in the 12 months preceding the claim
- SVTechPro shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
- SVTechPro is not liable for any losses caused by:
- Errors made by Community Admins in entering data, configuring rates, or recording payments
- Disputes between members and Communities about dues, payments, or access
- Failures of third-party services (Razorpay, Meta WhatsApp, FCM, SMTP providers)
- Force majeure events (natural disasters, power failures, internet outages, government actions)
12. Indemnification
You agree to indemnify and hold harmless SVTechPro, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third party's rights (including intellectual property or privacy)
- Content you upload or actions you take using the Service
- Disputes between you and your Community members or tenants
13. Third-Party Services
The Service integrates with third-party providers (Razorpay, Meta WhatsApp, Google FCM, Hostinger SMTP). Your use of these is also governed by their respective terms. SVTechPro is not responsible for third-party service failures, outages, pricing changes, or policy changes that may affect your experience.
If a third-party provider raises pricing or changes policies in ways that affect our operating costs, we may adjust our pricing accordingly with 30 days' notice.
14. Suspension & Termination
14.1 By Us
We may suspend or terminate your account immediately if you:
- Breach these Terms or our Acceptable Use policy
- Fail to pay subscription fees by the end of grace period
- Engage in fraud, abuse, or illegal activity
- Cause harm to the platform or other users
For non-payment, suspension is automatic via the Service after the grace period. We will provide email and WhatsApp warnings before suspension.
14.2 By You
You may cancel your subscription at any time by emailing admin@hcmpro.in. Cancellation takes effect at the end of the current paid period. See our Refund Policy for refund eligibility.
14.3 Effect of Termination
Upon termination:
- Your access to the Service ends
- You may request a data export within 30 days
- Data is retained per our Privacy Policy retention schedule
- Outstanding payments remain due
15. Changes to These Terms
We may update these Terms from time to time. When we do:
- The "Last updated" date will change
- Material changes will be notified via email to Community Admins at least 30 days in advance
- Continued use of the Service after the effective date constitutes acceptance
- If you do not accept the changes, you may cancel per Section 14.2
16. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Andhra Pradesh, India.
Before initiating legal action, both parties agree to attempt resolution through good-faith negotiation for at least 30 days. If unresolved, either party may proceed to court.
